1. Acceptance of Terms

By accessing or using AshAra's website, mobile application, or services, you agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use our services. We reserve the right to modify these terms at any time, and your continued use of the service constitutes acceptance of any changes.

2. Service Description

AshAra provides a premium fashion rental and purchase platform specializing in ethnic and formal wear for weddings, events, and special occasions. Our services include:

  • Rental of designer garments and accessories
  • Purchase options for select inventory
  • Trust & Loyalty rewards program with deposit discounts
  • AI-powered styling assistance and customer support
  • Secure payment processing through Razorpay

3. User Account & Registration

To use our rental services, you must create an account. You agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain the security of your password and account
  • Notify us immediately of any unauthorized use of your account
  • Accept responsibility for all activities under your account
  • Be at least 18 years old or have parental/guardian consent

We reserve the right to suspend or terminate accounts that violate these terms or engage in fraudulent activity.

4. Rental Terms

4.1 Rental Period

  • Rental periods are calculated from the start date to the end date selected at checkout
  • Items must be returned within 24 hours after the rental end date
  • Late returns may incur additional charges and affect your Trust Score
  • Extensions may be requested subject to availability and approval

4.2 Security Deposit

  • All rentals require a refundable security deposit
  • Base deposit = (Buy Price - Rental Price)
  • Trust & Loyalty members receive up to 50% discount on deposits
  • Deposits are refunded within 5-7 business days after item inspection
  • Deductions may apply for damage, stains, missing accessories, or late returns

4.3 Item Condition

  • Items are provided in excellent, pre-inspected condition
  • Normal wear and tear is acceptable; damage is not
  • Report any pre-existing damage within 24 hours of delivery
  • You are responsible for the item's care during the rental period
  • Professional dry cleaning is recommended but not mandatory

5. Trust & Loyalty Program

5.1 Earning Points & Discounts

  • Rental Discount: 5% per completed rental, up to 30% (6+ rentals)
  • Trust Score Discount: 1% per 10 trust points, up to 20% (200+ points)
  • Maximum Combined: 50% total discount on security deposits
  • Points Earned: 10 base points + bonuses for on-time returns and longer rentals

5.2 Membership Tiers

  • 🌱 New: 0 rentals / 0 points (no discount)
  • 🥉 Bronze: 1 rental / 10+ points (5-10% discount)
  • 🥈 Silver: 2 rentals / 20+ points (10-20% discount)
  • 🥇 Gold: 5 rentals / 50+ points (25-40% discount)
  • 💎 Platinum: 10+ rentals / 100+ points (up to 50% discount)

5.3 Point Deductions

  • Late returns: -10 to -25 points depending on delay
  • Item damage: -15 to -50 points depending on severity
  • Policy violations: -20 to -100 points or account suspension
  • Trust scores cannot go below zero

6. Payment Terms

  • All payments are processed through Razorpay's secure gateway
  • We accept UPI, credit/debit cards, net banking, and digital wallets
  • Payment must be completed before order confirmation
  • Prices are in Indian Rupees (₹) and include applicable taxes
  • Promotional discounts cannot be combined with Trust discounts
  • Refunds follow our refund policy (see section 8)

7. Delivery & Returns

7.1 Delivery

  • Delivery within 2-5 business days depending on location
  • Delivery charges may apply based on location and order value
  • Expedited shipping available for urgent orders
  • Signature required upon delivery

7.2 Returns

  • Return pickup scheduled within 24 hours after rental end date
  • Items must be returned in the original packaging when possible
  • Include all accessories, tags, and documentation
  • Purchases are final sale unless defective upon arrival

8. Cancellations & Refunds

8.1 Cancellation Policy

  • Cancel up to 48 hours before rental start: 100% refund
  • Cancel 24-48 hours before: 50% refund
  • Cancel less than 24 hours: No refund (rental fee retained)
  • Deposits are fully refunded upon cancellation before shipment

8.2 Refunds

  • Refunds processed within 5-7 business days
  • Refunded to original payment method
  • Processing fees may be non-refundable
  • Defective items: full refund including delivery charges

9. Prohibited Uses

You agree NOT to:

  • Sub-rent, sell, or commercially exploit rented items
  • Provide false information or impersonate others
  • Use the service for illegal activities
  • Damage, modify, or alter rented items intentionally
  • Attempt to circumvent security or payment systems
  • Abuse the Trust & Loyalty program or engage in point manipulation
  • Use automated systems (bots) to access the service
  • Interfere with other users' experience

10. Intellectual Property

  • All content, trademarks, logos, and designs are property of AshAra
  • Product images, descriptions, and videos are protected by copyright
  • You may not reproduce, distribute, or create derivative works
  • User-generated content (reviews, photos) grants us license to use for promotional purposes

11. Privacy & Data Protection

Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your personal information. Key points:

  • We collect data necessary for service delivery and improvement
  • Your payment information is processed securely by Razorpay
  • We do not sell your personal data to third parties
  • You can request data deletion subject to legal requirements

12. Liability & Disclaimers

12.1 Service "As Is"

AshAra services are provided "as is" without warranties of any kind, express or implied. We do not guarantee uninterrupted, error-free service.

12.2 Limitation of Liability

AshAra shall not be liable for:

  • Indirect, incidental, or consequential damages
  • Loss of profits, data, or business opportunities
  • Damages exceeding the amount paid for the specific order
  • Delays caused by third-party services (shipping, payment processors)
  • Events beyond our reasonable control (natural disasters, strikes, etc.)

12.3 Indemnification

You agree to indemnify and hold AshAra harmless from any claims, losses, or damages arising from your violation of these terms or misuse of rented items.

13. Dispute Resolution

13.1 Governing Law

These terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of courts in [Your City], India.

13.2 Arbitration

For disputes exceeding ₹50,000, both parties agree to attempt resolution through mediation before pursuing legal action.

13.3 Customer Support

14. Force Majeure

AshAra is not liable for failure to perform obligations due to circumstances beyond reasonable control, including but not limited to: natural disasters, war, terrorism, pandemics, government restrictions, strikes, or technical failures.

15. Severability

If any provision of these terms is found invalid or unenforceable, the remaining provisions shall continue in full force and effect.

16. Entire Agreement

These Terms and Conditions, along with our Privacy Policy, constitute the entire agreement between you and AshAra regarding the use of our services.
